These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Kite Network Limited ("Kite VPN", "Company", "we", "us", or "our") governing your access to and use of the Kite VPN application (the "App") and related services (collectively, the "Service"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

By accessing, downloading, installing, or using the Kite VPN Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. We reserve the right to refuse service to anyone at any time for any reason.

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet the eligibility requirements. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Kite VPN provides a Virtual Private Network (VPN) service that encrypts your internet connection, masks your IP address, and routes your internet traffic through secure servers across multiple global locations. The Service is designed to enhance your online privacy, security, and access to content. We strive to maintain high availability but do not guarantee uninterrupted or error-free service. Features, server locations, and available protocols may be modified at any time.

The Service, including its design, features, and content, is owned by Kite Network Limited and is protected by intellectual property laws. All trademarks, service marks, logos, and trade names displayed on the Service are our property or the property of their respective owners. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KITE NETWORK LIMITED, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Kite Network Limited, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you transmit through the Service.

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, if we believe you have violated these Terms or engaged in conduct that we determine to be inappropriate or harmful. Upon termination: (a) your right to use the Service will immediately cease; (b) we may delete your account data in accordance with our Privacy Policy; (c) provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by posting the updated Terms on our website and within the App, and updating the "Effective Date" at the top. It is your responsibility to review these Terms periodically. Your continued use of the Service after the posting of changes constitutes your acceptance of such changes. If you do not agree to the modified Terms, you must discontinue use of the Service.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law principles. Any dispute arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in San Francisco, California. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published by us on the Service, constitute the entire agreement between you and Kite Network Limited regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
